Apps made available through the App Store or Google Play Store are licensed, not sold, to you. Your license to tallerRx (the "Licensed Application") is subject to your prior acceptance of this Licensed Application End User License Agreement ("Standard EULA"). The Application Provider ("Licensor") reserves all rights in and to the Licensed Application not expressly granted to you under this Standard EULA.
Licensor grants to you a nontransferable license to use the Licensed Application on any devices that you own or control and as permitted by the Usage Rules set forth in the App Store Terms of Service and Google Play Terms of Service. The terms of this Standard EULA will govern any content, materials, or services accessible from or purchased within the Licensed Application as well as upgrades provided by Licensor that replace or supplement the original Licensed Application. You may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time. You may not transfer, redistribute or sublicense the Licensed Application. You may not copy (except as permitted by this license and the Usage Rules), reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Licensed Application.
You agree that Licensor may collect and use technical data and related information—including but not limited to technical information about your device, system and application software, and peripherals—that is gathered periodically to facilitate the provision of software updates, product support, and other services to you (if any) related to the Licensed Application. Licensor may use this information, as long as it is in a form that does not personally identify you, to improve its products or to provide services or technologies to you.
This Standard EULA is effective until terminated by you or Licensor. Your rights under this Standard EULA will terminate automatically if you fail to comply with any of its terms.
The Licensed Application may enable access to Licensor's and/or third-party services and websites (collectively and individually, "External Services"). You agree to use the External Services at your sole risk. Licensor is not responsible for examining or evaluating the content or accuracy of any third-party External Services, and shall not be liable for any such third-party External Services. Data displayed by any Licensed Application or External Service, including but not limited to financial, medical and location information, is for general informational purposes only and is not guaranteed by Licensor or its agents.
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE LICENSED APPLICATION IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSED APPLICATION AND ANY SERVICES PERFORMED OR PROVIDED BY THE LICENSED APPLICATION ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND LICENSOR HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE LICENSED APPLICATION AND ANY SERVICES, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND OF NONINFRINGEMENT OF THIRD-PARTY RIGHTS.
TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE LICENSED APPLICATION, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You may not use or otherwise export or re-export the Licensed Application except as authorized by United States law and the laws of the jurisdiction in which the Licensed Application was obtained.
This Agreement and the relationship between you and Licensor shall be governed by the laws of the Republic of Korea, excluding its conflicts of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within the Republic of Korea.
App Store 또는 Google Play Store를 통해 제공되는 앱은 판매되는 것이 아니라 귀하에게 라이선스가 부여되는 것입니다. tallerRx(이하 "라이선스 애플리케이션")에 대한 귀하의 라이선스는 본 최종 사용자 라이선스 계약("표준 EULA")에 대한 귀하의 사전 동의를 전제로 합니다. 애플리케이션 제공자("라이선스 제공자")는 본 표준 EULA에서 귀하에게 명시적으로 부여하지 않은 라이선스 애플리케이션에 대한 모든 권리를 보유합니다.
라이선스 제공자는 귀하가 소유하거나 제어하는 기기에서 App Store 및 Google Play 서비스 약관에 명시된 사용 규칙에 따라 라이선스 애플리케이션을 사용할 수 있는 양도 불가능한 라이선스를 귀하에게 부여합니다. 본 표준 EULA의 조건은 라이선스 애플리케이션 내에서 액세스하거나 구매한 모든 콘텐츠, 자료 또는 서비스뿐만 아니라 라이선스 애플리케이션을 대체하거나 보완하기 위해 제공되는 업그레이드에도 적용됩니다. 귀하는 라이선스 애플리케이션을 동시에 여러 기기에서 사용할 수 있는 네트워크상에서 배포하거나 사용할 수 있게 해서는 안 됩니다. 귀하는 라이선스 애플리케이션을 양도, 재배포 또는 서브 라이선스할 수 없으며, 라이선스 애플리케이션의 소스 코드를 복사, 리버스 엔지니어링, 디스어셈블리, 수정 또는 2차 저작물을 생성할 수 없습니다.
귀하는 라이선스 제공자가 소프트웨어 업데이트, 제품 지원 및 기타 서비스 제공을 용이하게 하기 위해 주기적으로 수집되는 기술 데이터 및 관련 정보(귀하의 기기, 시스템, 응용 소프트웨어 및 주변 기기에 대한 기술 정보를 포함하되 이에 국한되지 않음)를 수집하고 사용할 수 있음에 동의합니다. 라이선스 제공자는 귀하를 개인적으로 식별하지 않는 형태에 한하여 제품을 개선하거나 귀하에게 서비스 또는 기술을 제공하기 위해 이 정보를 사용할 수 있습니다.
본 표준 EULA는 귀하 또는 라이선스 제공자에 의해 종료될 때까지 유효합니다. 귀하가 본 표준 EULA의 조건을 준수하지 않을 경우 귀하의 권리는 별도의 통지 없이 자동으로 종료됩니다.
라이선스 애플리케이션은 라이선스 제공자 및/또는 제3자 서비스 및 웹사이트(총칭하여 "외부 서비스")에 대한 액세스를 가능하게 할 수 있습니다. 외부 서비스 사용에 따른 위험은 전적으로 귀하의 책임입니다. 라이선스 제공자는 제3자 외부 서비스의 내용이나 정확성을 검사하거나 평가할 책임이 없으며, 이에 대해 어떠한 책임도 지지 않습니다. 라이선스 애플리케이션이나 외부 서비스에 표시되는 데이터(금융, 의료 및 위치 정보를 포함하되 이에 국한되지 않음)는 일반적인 정보 제공 목적일 뿐입니다.
귀하는 라이선스 애플리케이션의 사용에 따른 위험이 전적으로 귀하에게 있음을 명시적으로 인정하고 동의합니다. 관련 법률이 허용하는 최대 범위 내에서, 라이선스 애플리케이션 및 그에 의해 제공되는 서비스는 "있는 그대로(AS IS)" 및 "사용 가능한 상태(AS AVAILABLE)"로 제공되며, 모든 결함을 포함하고 어떠한 종류의 보증도 없이 제공됩니다. 라이선스 제공자는 상품성, 만족스러운 품질, 특정 목적에의 적합성, 정확성, 향유권 및 제3자 권리 비침해에 대한 묵시적 보증을 포함하여 명시적, 묵시적 또는 법적인 어떠한 보증도 부인합니다.
법률에 의해 금지되지 않는 한, 라이선스 제공자는 인적 상해나 부수적, 특별, 간접적 또는 결과적 손해(일실 이익, 데이터 손실, 영업 중단 등)에 대해, 그 원인이 무엇이든 그리고 책임의 이론(계약, 불법행위 등)과 관계없이, 라이선스 제공자가 그러한 손해의 가능성을 사전에 알고 있었다 하더라도 책임을 지지 않습니다.
귀하는 미국 법률 및 라이선스 애플리케이션을 획득한 관할 구역의 법률에서 승인한 경우를 제외하고 라이선스 애플리케이션을 사용하거나 수출 또는 재수출할 수 없습니다.
본 계약 및 귀하와 라이선스 제공자 간의 관계는 대한민국 법률의 적용을 받으며, 법 저촉 규정은 제외됩니다. 귀하와 라이선스 제공자는 본 계약으로 인해 발생하는 분쟁이나 청구를 해결하기 위해 대한민국 내에 위치한 법원의 전속 관할권에 따를 것에 동의합니다.
